TRAILAIR, INC.’S LIMITED WARRANTY COVERING RECREATIONAL VEHICLE COMPONENTS

The following outlines TRAILAIR, INC.’S (“TRAILAIR”) warranty for its Recreational Vehicle Components and how we go about handling warranty claims. As always, contact TRAILAIR if you have any questions.

This warranty does not apply to any chassis, axle, specialty trailer, slide out system, leveling system, utility trailer, car hauler or any other product except as specifically stated herein.

Important! All warranty periods begin on the date of original purchase from TRAILAIR. This warranty is nontransferable and extends only to the original purchaser acquiring the product directly from a TRAILAIR Facility and shall not be construed to extend to any third party, including, but not limited to the ultimate purchaser of the end product. This limited warranty is valid only in the United States and Canada.

Recreational Vehicle Components: One Year Limited Warranty
All Trailair Recreational Vehicle Components come with a one (1) year limited warranty against defects in materials and workmanship, but does not cover the excluded items below. The covered Components are all TRAILAIR products, including, but not limited to, pinboxes, hitches and suspension products, but shall not include those parts manufactured by other companies which carry their own warranty.

Remaining Items Excluded From Limited Warranty: NO WARRANTY
To the extent permitted by applicable law, any and all items and components not specifically identified herein carry NO WARRANTY WHATSOEVER regardless of circumstance and are SOLD AS IS AND WITH ALL FAULTS. Inspection by the dealer and customer are your only protection on these items and TRAILAIR will not be liable for any defects, whether due to workmanship, materials or any other reason whatsoever. In addition, TRAILAIR does not warrant any hardware (nuts and bolts) or paint. This warranty does not cover roadside assistance or service calls to the unit’s location.

TERMS THAT APPLY GENERALLY TO ALL ASPECTS OF THIS RECREATIONAL VEHICLE COMPONENTS LIMITED WARRANTY

Unless otherwise specifically stated herein, if a TRAILAIR Recreational Vehicle Component is inspected by TRAILAIR and found to be defective in materials and/or workmanship in a manner that is covered by this Limited Warranty and within the applicable time period, TRAILAIR will, in its sole and absolute discretion, repair or replace the defective product or component as necessary.

Please contact TRAILAIR if you have any questions. TRAILAIR must inspect any and all items before they can be considered for warranty service or reimbursement. There are no exceptions to this procedure, so please contact TRAILAIR immediately before attempting any repairs or modifications.

This warranty does not cover customer instruction, installation, alignment, or adjustments. Because the Product is incorporated into the recreational vehicle or towing vehicle structure after the Product leaves the possession and control of TRAILAIR, TRAILAIR relies upon its customer to order and specify a Product of sufficient strength and durability to support the structure the Purchaser intends to place, and actually places, upon the Product. This Limited Warranty does not cover Components not supplied by TRAILAIR, the connecting of wiring, the attachment of running gear to the frame, or use of a Product on a unit other than the one to which it was originally mounted.

This Limited Warranty does not cover abuse, misuse or neglect which includes (without limitation) damages caused by: improper usage, overloading, accidents, unreasonable use, improper loading, incorrect weight bias loading, improper operation, improper repair, improper maintenance, improper connection to towing unit, normal wear and tear, driving at excessively high speeds while towing or attempted repair by anyone other than an authorized representative of TRAILAIR. This Limited Warranty does not cover chemical damage caused by acids, fuel, oil or other chemicals. Rust formation is not covered. This warranty does not cover any Product which is found to have been modified or altered in any way, including, but not limited to, installation of any and all after-market hauling attachments such as gooseneck adapters, pinbox extensions, tow hitches, or other attachments to the Product, the recreational vehicle, or the towing vehicle. TRAILAIR will not be liable for commitments or agreements made by any of its employees, agents, or dealers not in accordance with this warranty. The use of this unit as part of a rental fleet, or use for a commercial purpose, voids the warranty.

All claims are barred unless reported in writing by Purchaser to TRAILAIR, with full particulars, promptly after the damage was or reasonably should have been discovered and full facilities are offered TRAILAIR for inspection and investigation. TRAILAIR will not consider any claims pertaining to Recreational Vehicle Components, or component parts thereof, that are not in their original form.


TO THE GREATEST EXTENT PERMITTED BY LAW, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY LIMITED TO THE SAME PERIODS OF TIME AND COMPONENTS PREVIOUSLY IDENTIFIED UNDER THIS LIMITED WARRANTY. EXCEPT AS PROVIDED IN THE LIMITED WARRANTY, THE RECREATIONAL VEHICLE COMPONENTS ARE BEING SOLD “AS IS” AND “WITH ALL FAULTS”. ANY AND ALL RISKS AS TO THE QUALITY AND PERFORMANCE OF THE RECREATIONAL VEHICLE COMPONENTS NOT CONTEMPLATED BY THIS LIMITED WARRANTY SHALL BE BORNE EXCLUSIVELY BY THE PURCHASER. SHOULD THE GOODS PROVE DEFECTIVE FOLLOWING THEIR PURCHASE, PURCHASER, NOT TRAILAIR, ASSUMES THE ENTIRE COST OF ALL NECESSARY SERVICING OR REPAIR WHICH IS NOT COVERED UNDER THIS LIMITED WARRANTY. REPAIR, REPLACEMENT OR CREDIT AS PROVIDED HEREUNDER IS THE EXCLUSIVE REMEDY OF THE PURCHASER. IN NO EVENT WILL TRAILAIR BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.


Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty is intended to comply with the Magnuson-Moss Warrranty Federal Trade Commission Improvement Act and any provisions of this warranty or actions taken by TRAILAIR pursuant to this warranty shall be construed accordingly.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

Third-Party Events – In the event of any accident, injury to person, damage to property, loss or other occurrence involving a TRAILAIR Recreational Vehicle Component, Purchaser shall notify TRAILAIR of such event within thirty (30) days of the event or within ten (10) days of notification to Purchaser, whichever is earlier. Notwithstanding the foregoing, Purchaser shall notify TRAILAIR immediately upon learning that a survey, test or inspection is to be made with respect to the TRAILAIR Recreational Vehicle Component and provide TRAILAIR with the opportunity to participate in any such survey, test or inspection, or to permit TRAILAIR to conduct its own survey, test or inspection. Failure of the Purchaser to comply with this paragraph shall constitute a waiver of all of Purchaser’s rights hereunder. Waiver by TRAILAIR of any provision hereof shall not constitute a waiver as to any other provision, and shall not affect the right of TRAILAIR to exercise thereafter any right or remedy.

Any legally or otherwise invalid provision hereof shall be considered severable.

Any conditions or exceptions which may be stated in any communication or document received by TRAILAIR from any entity or individual, including but not limited to the Purchaser, shall be of no effect unless specifically agreed to in writing by TRAILAIR.

The current warranties and terms outlined on TRAILAIR’S website (www.trailair.com) on the date of purchase shall take precedence over any other warranties whether verbal or written. TRAILAIR reserves the right to alter its warranties from time to time, as the laws and the company’s business needs and industry change.

This Limited Warranty shall be governed by and construed in accordance with the laws of the State of Indiana without regard to principles of conflicts of law. Any disagreement, dispute, controversy or claim arising out of or relating to this Limited Warranty shall be settled by binding arbitration in accordance with the Rules of the American Arbitration Association. Judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

In order to process your claim, TRAILAIR AND LIPPERT COMPONENTS will need the following information: Vehicle Identification Number (VIN), Date of Manufacture, Date of Purchase, and the Make and Full Model Number. Please include this information with any correspondence and have this information available when you call.
